An intoxicated Wodonga man has terrorised a Lavington neighbourhood, throwing bins, smashing cars, and damaging trees.
Nathan Kade Gaffy pleaded guilty at the Albury Local Court on Monday, March 15, to two counts of destroy/damage property, enter a vehicle without consent from the owner, behave in an offensive manner in a public place, and resisting arrest.
Court documents reveal the 31-year-old was seen standing in the middle of Eden St, flailing his arms around, while cars swerved to avoid him about 7pm on February 2.
Two unknown associates attempted to calm him down.
A witness followed Gaffy and saw him climb into the driver’s seat of an Isuzu truck parked on Buchhorn St before being pulled from the vehicle by his associates.
Gaffy then climbed into the back of the vehicle before being removed again.
The owner of the Isuzu saw Gaffy climbing inside and confronted the drunk man.
Court documents show Gaffy hurled abuse at the victim before walking north on Buchhorn St, damaging trees as he crossed Urana Rd.
Gaffy was captured on video punching a Holden Barina’s side mirror on Breen St three times before using his elbow to try and break the driver’s side window causing $500 in damages.
The offender then walked up the kerb, knocking over full garbage bins and spreading rubbish everywhere.
He then picked up a bin and repeatedly threw it at a Hyundai Sonata, denting the side panels, the bonnet and smashing the windscreen, which caused between $3000 and $5000 worth of damage.
When police arrived at the scene and tried to arrest Gaffy, he pulled his arms away.
Gaffy was then tackled to the ground by police, where the accused pulled his arms under his body to prevent being handcuffed.
Police transported the drunk man to the Albury Police Station and he was put in a time-out to sober up.
The man was treated by NSW Ambulance for cuts to his head and arms.
Gaffy represented himself in court, with his fiance supporting him.
The concreter said he couldn’t remember anything from about 3pm to 10pm on the night of his offending.
Police prosecutor Andrew Coombs said it was a very serious case of destroy/damage property with the Hyundai written-off as a result of the damage caused by Gaffy.
Magistrate Richard Funston was appalled by Gaffy’s behaviour.
“This is major acting out behaviour, complete intoxication causing blackout,” Mr Funston said.
Gaffy told the court he had not been drinking since that night.
“It’s in everyone’s interest you address this alcohol problem you’ve got …” Mr Funston said.
“You need to get the help or else you’ll be locked up.”
For the destroy damage property charges Gaffy was sentenced to a 12-month Community Corrections Order with supervision.
For the behave in an offensive manner charge he was fined $300, and for entering a vehicle without consent he was fined $200.
