Ashley Rigby: Lavington man robbed man staying at Albury Classic Inn

A Lavington man who stole thousands from an elderly cancer sufferer while he was staying at an Albury hotel has been sentenced in court.

A Lavington man stole thousands from a cancer sufferer after breaking into his hotel room at Albury Classic Motor Inn, a court has heard.

Ashley Rigby, 26, was jailed for 19 months in Albury Local Court on Tuesday after pleading to aggravated breaking and entering and dishonestly obtaining financial advantage by deception.

The court heard Rigby and his co-offender were staying at Albury Classic Motor Inn on February 25 when they broke into another Phillip Mohr’s room who had been staying there while battling stomach cancer.

Just before 5am, CCTV footage shows the offending pair loitering around the victim’s room, before they entered using the key left in the door and stealing his phone, cigarettes and wallet containing $145 cash and bank cards.

The pair were able to change the victim’s online banking password and reset the card’s PIN numbers, which they used to withdraw $4092 at a nearby ATM.

CCTV footage shows the pair splitting the money, despite Rigby’s claims he didn’t receive any funds.

Rigby was able to be identified using his distinctive arm tattoo that was visible on CCTV footage.

On March 1, police found the victim’s personal cards in Rigby’s motel room, along with the clothing he wore on the night of the crime.

Rigby’s DNA was also found on the victim’s stolen cards.

He told the court he felt remorse for the victim.

“This is not my life. This is a big wake up call for me,” Rigby said.

“This is the time to make your mum proud - do your time wisely,” Magistrate Richard Funston said.

“I won’t let you down,” Rigby said.

He was sentenced to 18 months imprisonment with a nine month non-parole period.
