TWO men have been fined after one was found masturbating and another naked with an erection near a nudist beach at Byron Bay, police allege.

New South Wales police said officers were patrolling the dunes, just south of the designated clothing optional area at Tyagarah Beach, when they saw a man sitting under a tree masturbating on Wednesday, October 7.

“Police further observed another fully naked male, with an erection standing over the other male and both were looking at each other,” a NSW police statement said.

When one man noticed police he “took off on foot completely naked” before being apprehended on the beach, police allege.

Police said one man, 54, said he was holidaying from Newcastle while the other man, 37, was living out of his car.

They were both issued an infringement notice for “offensive behaviour”.

Tyagarah Beach is a clothes optional beach where nude bathing is permitted. The clothes optional area stretches for 800m and starts 200m south of Grays Lane.

Police will continue to conduct patrols of these areas and act against those not complying, the statement said.
