A MAN will serve six months’ jail for raping a woman at a house party while she slept in her own bed with her children.

She was left bleeding and was forced to move house due to the anxiety of living in the same home.

Scott David Congdon pleaded guilty in the Southport District Court on Wednesday to one count of rape.

Judge David Kent sentenced him to two-and-a-half years prison to be suspended after he had served six months.

“The impacts on the victim are substantial and ongoing,” he said.

“In my view she was entitled to feel safe in her own home and own bed.”

The court was told the woman felt so uncomfortable in her own home the family had to move. The couple also purchased a new bed.

In a victim impact statement read to the court the woman said the rape had “taken away her power and caused fear and anxiety”.

Prosecutor Kathleen Christopherson told the court that Congdon, 26, had been drinking at the woman’s home in November last year as part of a house party.

The woman drunk two bottles of wine and started to feel sick and went to bed with her children.

Ms Christopherson said she got up to shower and was sick before returning to bed.

That is when Congdon began to come in and out of the room three times.

Ms Christopherson said at one stage the woman woke to see him digitally raping her.

The rape was so forceful she was left with a cut on her cervix.

Defence barrister Angus Edwards, instructed by Ashkan Tai Lawyers, said Congdon was “sickened” when police read him the woman’s statement and he did not remember the incident.

Mr Edwards said Congdon told police: “I don’t even know why I would have been there.

“If I have done this sickening thing I would like to say sorry but I don’t know what happened.”

The court was told Congdon, who works in a security screen business, had drunk about 20 beers and smoked cannabis that night.

“He is usually respectful of women and this is completely out of character for him,” Mr Edwards said.
