A GOLD Coast radiology clinic is facing a fine of up to $33,300 for allegedly failing to back pay leave entitlements to an international worker.

The Fair Work Ombudsman has started legal action in the Federal Circuit Court against Queensland Xray Group Pty Ltd trading as Uniradiology at Southport.

It is alleged the clinic was issued a Compliance Notice in December last year after they failed to pay the Zimbabwe worker leave entitlements at the end of her employment.

A Fair Work spokesman said Uniradiology allegedly failed to back pay the woman, who was on a temporary skills shortage visa, $1551.41.

“The Fair Work Ombudsman made several attempts to secure voluntary compliance with the Compliance Notice before commencing legal proceedings,” he said.

“The regulator is seeking an order for the company to comply with the Compliance Notice, which includes rectifying the alleged underpayment in full plus interest.

“The FWO is also seeking a penalty against Queensland Xray Group Pty Ltd. The company faces a possible maximum penalty of $33,300.”

Fair Work ombudsman Sandra Parker said the regulator would continue to enforce workplace laws and take businesses to court where lawful requests are not complied with.

“Compliance Notices are important tools used by inspectors to deal with apparent contraventions of the Fair Work Act or industrial instruments, most typically Modern Awards,” Ms Parker said.

“Where employers do not respond to or comply with these Notices, we will take appropriate enforcement action to protect employees.

“A court can order a business to pay penalties for not complying with such a Notice, in addition to back-paying workers as appropriate.”

A directions hearing is listed in the Federal Circuit Court in Brisbane on August 27.
