A woman flagged down a car for help in Surfers Paradise. She ended up in the middle of a nightmare, with a stranger on top of her, her underwear around her ankle and her body suit undone.

A woman woke up with a stranger on top of her, her underwear around her ankle and her body suit undone after flagging down a car for help in Surfers Paradise.

The 22-year-old woman had to asked Mohammed Yusuf Ali twice to stop before he got off her.

Ali, 31, pleaded guilty in the Southport District Court on Thursday to sexual assault.

He walked from court after his three-year prison sentence was suspended.

Judge Bernard Porter said: “Young women can be in distress on the street for all sorts of reasons and they are entitled to be safe from being preyed on.”

Prosecutor Kathleen Christopherson said the woman, who had recently immigrated from New Zealand, went out in Surfers Paradise on November 25, 2018.

When she went to go home about 4.30am, she could not find her car and could not get a taxi because she had run out of money and her mobile phone was flat.

She started flagging down cars and Ali stopped and agreed to help her.

While they were driving around, the woman fell asleep.

Ms Christopherson said she woke up with her jeans down, body suit unbuttoned, her underwear around one ankle and Ali on top of her.

“She told him to ‘get off, you can’t do this, please get off, you can’t do this’,” she said.

Ms Christopherson said he stopped after the second plea.

Defence barrister James McNab, instructed by Allen & Searing Criminal Lawyers, said Ali had a long history of cannabis abuse.

Ali, who lives in Labrador, has been diagnosed with schizophrenia but it is not believed the illness contributed to the offending.
