A Mongols bikie office bearer who was caught wearing gang colours with other members including high-profile Harley Barbaro has escaped further punishment.

A MONGOLS bikie office bearer caught wearing gang colours with other alleged members, including Harley Barbaro, has escaped further punishment.

Matthew Stephen Hutchins pleaded guilty in the Southport Magistrates Court on Thursday to one count of habitually consorting between January 13 and July 14 last year.

Police prosecutor Senior Constable Erin Livingston told the court that Hutchins, 28, was a confirmed office bearer of the Mongols bikie gang.

Sen Const Livingston said Hutchins had been served with a consorting notice banning him from meeting or contacting other criminals, including Barbaro and Sonny Jenkins.

Police allege Barbaro and Jenkins are both Mongols gang members.

Barbaro is the brother of underworld figure Pasquale Barbaro, who was shot execution-style in Sydney in 2016.

Sen Const Livingston said Hutchins was found to be dining at a restaurant in Southport in January last year with Barbaro.

He was spotted at a Mongols Memorial Run with Barbaro and other Mongols members on January 7, the court was told.

Sen Const Livingston said that about 1am on January 8 police stopped Hutchins and Barbaro in Surfers Paradise. She alleged both were wearing Mongols shirts.

She said police also found 52 messages between Hutchins, Barbaro and Jenkins after searching Barbaro’s phone.

Magistrate Kerry Magee said Hutchins had been sentenced to two years’ prison in August last year for fraud offences and if the consorting matters had been heard at the same time Hutchins would not have received a further punishment.

She ordered a conviction be recorded but that Hutchins not receive additional punishment.
