Lance Rick Dealey, 38, charged after alleged assault on Studio Drive in Oxenford

A man allegedly assaulted his first victim’s brother when he tried to intervene, threatening to come back to the Gold Coast home if they called the police.

A man accused of attacking a sleeping man with a weapon – then assaulting the man’s brother when he came to his aid – was on bail on another assault charge, a court has been told.

Lance Rick Dealey was charged with two counts of assault occasioning bodily harm and one of wilful damage after the alleged altercation at Oxenford on Wednesday.

Police were called to a home on Studio Drive at about 2.30pm after reports of an incident involving three men.

Two of those involved, aged 32 and 26, were transported to Gold Coast University Hospital in stable conditions with facial injuries.

Mr Dealey, 38, was arrested on nearby Hepburn St a short while later. It is alleged all three men were known to each other.

Southport Magistrates Court was told during Mr Dealey’s bail application on Thursday that police would allege he attacked one of the men with a weapon while he was sleeping, then turned on a second man – understood to be the first’s brother – when he tried to intervene.

It was heard Mr Dealey allegedly hit, kicked and spat into someone’s mouth during the assault, threatening to come back if they called the police.

He was on bail at the time on several charges including assault occasioning bodily harm, the court was told.

Duty lawyer Georgia D’Arcy said she was instructed that the alleged offending was triggered by a relapse, and that Mr Dealey would be willing to go to his doctor for a drug and alcohol program referral if granted bail.

Ms D’Arcy said it was accepted it was a strong Crown case – though some facts would be disputed – and that her client could live at the Tweed with a no-contact order for both alleged victims and any witnesses.

Acting Magistrate Sarah Thompson refused Mr Dealey’s bail, saying he was allegedly undeterred by the stringent bail conditions he was already on at the time and she was unsatisfied any further orders would mitigate the risk of his release.

Mr Dealey’s case was adjourned to August 23.

Investigations are ongoing, with police calling for anyone who witnessed the alleged incident or has more information to call 131 444.
