A GOLD Coast businessman repeatedly punched at a cab driver’s head before wrapping his arms around his neck during a ride in Broadbeach.

Samuel John Moses only stopped when police reached into the cab to stop him in the early hours of March 5 this year.

Moses’ mother and aunt were in the back of the cab watching it happen.

The 45-year-old pleaded guilty in the Southport Magistrates Court on Wednesday to assault occasioning bodily harm.

The court was told Moses, his mum and aunt got into the cab and Moses got into a verbal altercation with the driver.

The cab driver flagged down a passing police car and as the car did a u-turn Moses began to hit the driver.

Magistrate Grace Kahlert sentenced him to 18 months probation.

“It is deliberately a longer period because this sort of issue does not go away overnight,” she said.

Magistrate Kahlert viewed CCTV footage of the attack and said: “You were clearly grossly intoxicated and you can barely keep you head up.”

She denied a media application for a copy of the CCTV footage saying it would be detrimental to Moses’ family.

Outside of court Moses said: “I’m extremely remorseful for what I’ve done.

“I am sincerely sorry. It’s not who I am. You can’t judge one man on one bad moment.”

Defence lawyer Allanah Patron, of Brooke Winter Solicitors, said Moses “felt a great amount of shame” that his mother and aunt had witnessed his bad behaviour.

She said Moses had a problem with alcohol but since the incident had sought counselling and was sober. She also tendered 18 clean urine tests.

Ms Patron said Moses had also been on painkillers following surgery the month before.
