Hope is growing in notorious fraudster Peter Foster’s camp that the latest case against him could be dropped after an upcoming hearing interstate.

Mr Foster returned to Southport Magistrates Court on Tuesday, where he faces charges of fraud and related offences in relation to an alleged Bitcoin scam run from 2019 and 2020.

Defence lawyer Chris Hannay said several lots of material were still outstanding – including bank statements from Singapore – and that there was not much they could do before they were provided.

Speaking later outside the courthouse, Mr Hannay said they were also awaiting a hearing in Sydney in December, where they hoped to gain access to the full report investigating NSW Police processes that led to Mr Foster’s now-infamous arrest on a Port Douglas beach in 2020.

“We’ve got some of the material, which indicates to us some significant issues we have with the way that this investigation was conducted in the first place,” Mr Hannay said.

“I can’t see in the long term that Peter’s matter is going to proceed much past that – that’s what we’re hoping for and that’s what we’re aiming for.

“I’m pretty confident in one way or another there’ll be some massive changes to what’s happened.”

Mr Foster said it felt as though they were “finally getting there”.

“You’ve just got to never give up,” he said.

“Just when I think I’m ready to live happily ever after, bugger me, here we are again – it just rolls on and on and on.”

His case is due to return to court on January 21 next year. Mr Foster remains on bail.
