An evicted nightclub patron has accused Surfers Paradise security of assault and racist comments – after walking free from court when he successfully charges against him were dropped.

A nightclub patron has accused a Gold Coast security guard of assaulting him and making racist comments on a night out in Surfers Paradise.

Satyawan Satyawan, 35, made the allegations outside the Southport Courthouse after a magistrate dismissed two charges against him of failing to leave a licensed premises and wilful damage.

The charges were dropped after police prosecutors failed to organise a security guard witness and another police officer to appear at Mr Satyawan’s hearing in Southport Magistrates Court on Tuesday.

By contrast, Mr Satyawan had organised three witnesses of his own, who were present.

The charges were laid against the 35-year-old after a night out in November last year, where Mr Satyawan alleged a security guard at The Avenue nightclub targeted his group of friends.

“I didn’t do anything wrong. The security guard made some racist comments to us while we were drinking at the club,” he alleged.

“When we were drinking he was trying to say, ‘don’t talk loud, please put your volume down’.

“If you’re drinking in a club, you’re supposed to have a good time and talk.”

Mr Satyawan said his group then stood outside, but one of his friends was refused entry when they tried to re-enter.

The 35-year-old said when he questioned this with the security guard, he was told “don’t stand near the door”.

Mr Satyawan alleged the guard then pushed him three times, causing an iPad the guard was holding to fall to the ground, damaging it and resulting in the wilful damage charge.

The Bulletin contacted The Avenue but did not receive a response by deadline.

Mr Satyawan said he tried to have the guard charged with assault, but police told him there was a lack of evidence.

A police prosecutor told the court a different version of events, alleging Mr Satyawan was removed from the venue.

It was alleged he then lashed out at the security guard, which resulted in damage to the iPad.

At Tuesday’s hearing, the police prosecutor requested an adjournment because a security guard witness and another police officer had not been organised to appear.

Magistrate Dzenita Balic refused it, noting the hearing was scheduled 10 weeks ago.

She said Mr Satyawan, who was self represented, had arranged his own three witnesses to take time off work to appear.

After the adjournment was refused, the police prosecutor provided no evidence to Mr Satyawan’s charges of failing to leave and wilful damage.

Magistrate Balic dismissed both charges and Mr Satyawan walked free.

“It’s a lot of hassle. I came all the way from northside (Brisbane),” he said outside court.

“At least I had a win, so I’m happy to leave it there.”

Mr Satyawan’s allegations came after security guards were filmed pushing two people down a flight of stairs in a separate incident outside a Gold Coast hotel.
