A counsellor was allegedly caught on tape planning to lie about a Mongols bikie’s therapy attendance ahead of his sentencing for a horrific assault, police will allege.
Mongols bikie James Winston Mau’u was last month charged with attempting to pervert the court of justice with the alleged plan.
His matter was mentioned briefly in the Southport Magistrates Court this week.
Mau’u’s charges come after his counsellor, Tweed Heads-based Carly-Lee Allen, was charged in March last year with two counts of attempting to pervert the court of justice.
She has strongly denied the allegations and will face a committal hearing on May 3. She is yet to enter a plea.
The Bulletin can reveal for the first time more details of the police allegations against Mau’u and Allen, including a conversation between the pair.
Police allege that Allen and Mau’u had a phone conversation on April 13, 2021 where they spoke about the report the counsellor would be providing to the court.
It is alleged the report provided to the Southport District Court included that Mau’u had attended weekly counselling started on November 5, 2020.
Police allege that Mau’u’s first counselling session was on April 13, 2021 and he did not attend 38 counselling sessions as the report detailed.
The report was allegedly used in the sentencing proceeding where Mau’u had pleaded guilty to grievous bodily harm after beating another man with a metal weight plate in an Upper Coomera gym.
Police claim the alleged deception was uncovered as Mau’u and other Mongols bikies had their phones tapped during the investigation into the murder of bikie Shane Bowden in Pimpama.
Mau’u and nine others have since been charged with Bowden’s murder.
It is alleged it was that phone tap which picked up the call between Mau’u and Allen on April 13, 2021.
Police allege that during that 40 minute phone call:
* Allen allegedly told Mau’u that his “having a home invasion, GBH (grievous bodily harm) and AOBH (assault occasioning bodily harm) we target in my report anger management and things like that...”
* Allen allegedly told Mau’u she would not document things he did not want her to as it could be subpoenaed.
* Allen allegedly told Mau’u she would not document his admission to being a member of the Mongols. She allegedly said: “Um, that then you know that’s gonna come into play with sentencing as well. Obviously not in my report. I’m not going to mention it.”
* When speaking about Mau’u’s affiliations with the Mongols, Allen allegedly says: “ … I know a lot of bikie gangs and things like that are frowned upon, um, but it is sometimes good for the younger guys that are a little bit lost in society because they kind of get told to tame down a bit …”
* It is alleged that when Mau’u refers to assaulting a prison officer inside jail, Allen replies: “We don’t mention that s***”.
* When speaking about when the gym assault occurred, Allen allegedly said: “November 2020. Alright I reckon what we do is say since December, maybe December that you’ve been engaged with anger management, um, and counselling reason being is if you don’t reoffend it’ll demonstrate it’s having a positive impact …”
* Police allege that when Mau’u denies he has any substance abuse problems, Allen replies: “We need some problems.”
Police allege it is in this conversation that Mau’u and Allen agreed to lie about the bikie engaging in weekly counselling sessions.
Both deny the charges and are yet to enter a plea.
Mau’u will next appear in court on February 14.
