A Lone Wolf bikie has admitted to a violent assault which left a man eating through a straw - two weeks after being discharged of an alleged double murder.
OMCG member Nathan Miller punched a man and then kicked him in the head after a verbal fight while intoxicated in Surfers Paradise about 3am on July 27, 2019.
The 36-year-old then watched as his accomplice stomped on the victim’s head three times.
Miller pleaded guilty in the Southport Magistrates Court on Wednesday to assault occasioning bodily harm while in company.
The guilty plea comes about two weeks after it was found in the Southport Magistrates Court there was not enough evidence for Miller and co-accused Garry Brush and Brodie Singh to stand trial of the murders of ex-bikie Shane Ross and his business partner Cameron Martin in October 2019.
Magistrate Dzenita Balic sentenced Miller to nine months’ prison wholly suspended.
Miller has been in custody for more than 700 days.
“There would have been at least a physical, if no psychological impact,” she said.
“He could not eat solid foods for a while and he had to eat through a straw.”
The court was told the assault happened after a verbal argument with another group on a night out in Surfers Paradise.
Miller punched the victim in the head. When the victim got up and the verbal argument continued then Miller kicked him in the head.
While the victim was on the ground, Miller’s accomplice stomped on the victim’s head three times.
Miller’s lawyer Jason Grant, of Grant Lawyers, said the attack was prompted by the verbal argument.
“It was not that it was a random attack walking through Surfers Paradise,” he said.
“It was 3.10 in the morning and everyone was highly intoxicated.”
Mr Grant said Miller had always indicated he was going to plead guilty, but the case had been delayed by the charges which were discharged two weeks ago.
Those charges related to the deaths of Mr Ross and Mr Martin.
Mr Grant said Miller was also in custody for other serious charges in Ipswich.
He is expected to make a bail application on those charges on Thursday.
