Four alleged bikies accused of an ambush attack with an umbrella on an alleged member of a rival gang outside a Helensvale gym are set to stand trial.
Six alleged Mongols – Harley Joe Barbaro, Sonny Brandon Jenkins, Luke Dillon Tobin (also known as Maksoud), Matthew Stephen Hutchins, Trent Nathan Young and Tama David Lewis – are accused of ambushing Dale Moore, an alleged member of the rival Rebels gang, outside of the Iron Asylum Gym about 2.30pm on February 28 last year.
All six are charged with assault occasioning bodily harm while a member of a serious organised crime group. Hutchins is also charged with wounding.
The group are alleged to have been waiting for Mr Moore before they attacked, repeatedly punching and kicking him.
It is alleged at one point Mr Moore was stabbed with what is believed to be an umbrella.
Mr Moore has provided a statutory declaration saying he consented to the fight, the Southport Magistrates court was told.
On Wednesday, Magistrate Jane Bentley committed Barbaro, Jenkins, Lewis and Young to stand trial in the Southport District Court in the coming weeks.
Hutchins and Tobin are yet to be committed after an administrative error on Wednesday meant they were not transferred from prison to appear in court and no video link had been organised.
None have entered a plea.
The decision to commit was made after a committal hearing was held last year, where the court was told the group of alleged bikies believed Mr Moore consented to the fight.
In handing down her decision on Wednesday Magistrate Bentley noted that CCTV played to the court showed at points Mr Moore backing away, being held down by one person while another punched him, falling to the ground were he was stabbed by what appears to be an umbrella and jumping in a car to get away.
“It seems to me that consent was withdrawn,” she said.
“That includes when he was being held down and when he attempts to walk away.”
Magistrate Bentley said police had seen Mr Moore with injuries the day after the fight. She said he told police he was injured from falling off his Harley Davidson.
She said there were images that showed Mr Moore had two black eyes.
Magistrate Bentley ordered the men stand trail in the Southport District Court in the coming months.
None of the men spoke as they left court on Wednesday.
