A father who slapped and repeatedly kicked a prospective business partner at his Gold Coast car dealership claims he was threatened by his victim, a court has been told.

Gold Coast Automobiles owner Parvis Amiri was sitting outside his business with the victim and the other man’s friend on January 16, 2022 when he suddenly became “agitated and argumentative”.

Southport Magistrates Court was told the victim owned a tyre business, and the pair were discussing a potential contract or investment in the lead-up to the assault.

Prosecutor Dan Cuschieri said Amiri stood up and slapped the other man across the face.

Mr Cuschieri said Amiri then kicked his victim in the chest, throwing him back in his chair, and repeatedly kicked him in the lower back until the third man intervened.

“The victim stated he felt immediate pain and discomfort, and experienced difficulty breathing,” Mr Cuschieri said.

Amiri later denied the assault.

The court was told the 38-year-old was in 2017 convicted of common assault, after he punched someone in the jaw from behind while at SinCity Nightclub in Surfers Paradise.

Defence lawyer Philip Whitehead claimed the victim and his friend turned up unannounced at Amiri’s Labrador business and “put him under pressure” to repay money he owed.

“It became an argument that resulted in some threats that my client would have to pay (the victim) or else, (and) he didn’t want to leave without the money,” Mr Whitehead said.

“He was asked on two occasions to leave the premises, and could have taken this up with his own legal counsel but he chose not to.

“(Amiri) regrets the incident, he certainly didn’t want it to occur, and in the future would never involve himself in any physical altercation that resulted in an assault before the court.”

Amiri pleaded guilty to one count of common assault.

He was fined $1000 and ordered to pay $500 in compensation to his victim.

No conviction was recorded.
