Fredrick Dallas Ramukian, 27, admits unprovoked assault in Surfers Paradise - and walks free

A foreign student who admitted bashing a skateboarder in an unprovoked attack on the Gold Coast has walked from court with no conviction. Read why the Magistrate let him off.

A foreign student involved in a group bashing of a skateboarder at Surfers Paradise has walked free with no conviction.

Fredrick Dallas Ramukian and two friends had been out celebrating his birthday on June 2, when the intoxicated 27-year-old lashed out at the passing rider at 6.45am outside a hotel.

Police prosecutor Rodney Keyte told Southport Magistrates Court on Tuesday: “The defendant (Ramukian) has, without warning, violently assaulted the victim in an unprovoked manner, punching him (victim) with a closed fist to the head causing the victim to fall to the ground and remain motionless.”

The court heard Ramukian’s friend allegedly began kicking the skateboarder who lay unconscious on the footpath before a third male in the group intervened to stop it.

Council cameras tracked the trio as they left in a taxi and travelled to the Broadwater Parklands in Southport and began cooking a BBQ before police arrested them.

“When asked (Ramukian) made admissions (to police) about punching the victim and even referred to the victim as innocent,” Mr Keyte told the court.

“This is gratuitous violence and typically this would usually see a term of imprisonment.”

Ramukian’s lawyer Samuel Hwang told the court his client “deeply regrets” the unprovoked assault, which left the victim in hospital.

“It was just impulsive and stupid. There is no excuse,” Mr Hwang said.

“At the time, everyone was intoxicated and there was no real planning.”

Ramukian had since begun counselling for anger management and sought treatment for substance misuse, and offered to pay compensation to the victim.

Mr Hwang asked the court to consider not recording a conviction for assault occasioning bodily harm due to possible impacts on his client who is in Australia on a student visa.

Magistrate Nerida Wilson said during sentencing: “The community here needs to be safe, I cannot stress that strongly enough.

“The last thing they need is for a drunken lout at the end of his birthday harming them.”

Magistrate Wilson accepted a number of mitigating factors worked in Ramukian’s favour including his timely guilty plea and admissions to police about his actions, resulting in him being charged.

She ordered he serve 12 months probation and pay $1000 in compensation. No conviction was recorded.
