Albert Avery joins group assaulting man at Surfers Paradise

A teen who joined a group of 10 men gang bashing another on a night out in Surfers Paradise has been labelled “cowardly” by a magistrate.

Albert Avery, 18, pleaded guilty to one count of assault occasioning bodily harm in the Southport Magistrates Court, after he involved himself in an all-out brawl on the Glitter Strip in May.

Avery was captured on CCTV running to join a group of men bashing a 19-year-old man at Surfers Paradise just after midnight on May 11, the prosecutor told the court.

She said the victim attempted to run from the group multiple times, but the other men were dogged in their attack.

Avery ran to join the group of roughly 10 men, and punched the victim in his chest and head, continuing to chase down the man who was desperately trying to escape.

The prosecutor said there was no allegation Avery instigated the attack, but certainly contributed to the assault.

She said an aggravating feature was the assault occurred in the safe night precinct, an area where the victim “should have felt safe”.

Magistrate Joan White labelled Avery’s actions as “cowardly.”

The defendant’s solicitor said the 18-year-old was remorseful, but there were “some words said” to the people Avery was with which triggered the attack.

Given his lack of history and his youth, Magistrate White imposed a $350 fine referred to SPER and ordered him to pay $350 criminal compensation.

No conviction was recorded.
