Jayden James Spakianos sentenced after pleading guilty to aggravated cause serious harm with intent

He stabbed an innocent commuter at an Adelaide bus interchange then walked away laughing – now this young southern suburbs man has learnt his fate.

A young southern suburbs man who stabbed an innocent commuter before walking away laughing has been jailed for up to five years.

Jayden James Spakianos, 20, fronted the District Court for sentencing on Tuesday after pleading guilty to the drug-induced paranoiac attack on Scott Wimshurst, 26, in September 2023.

Mr Wimshurst suffered a punctured and collapsed lung following the stabbing, and had to be rushed to hospital with life-threatening injuries.

The court heard Spakianos, of Morphett Vale, was at the Noarlunga Centre bus interchange on the day of the attack and noticed Mr Wimshurst across the road – telling his uncle he would “kill this guy right now”.

“Mr Wimshurst smirked as he thought you were just trying to act tough and you asked ‘what are you smiling at?’ and began walking towards him,” Judge Joanne Tracey said.

“He told you that he was not smiling at anything and that you were just being stupid and to leave him alone.

“You said: ‘Stop smiling, I’ll kill ya’. Mr Wimshurst put up his arm and said: ‘Look man, I don’t want to do this, leave me alone’.”

The court heard Spakianos reached into his jacket and pulled out a knife, before stabbing Mr Wimshurst underneath his shoulder blade.

The court previously heard Spakianos was on bail at the time of the offending – and was under the influence of alcohol, amphetamines and prescription medication which resulted in paranoia.

Last year, Kassandra Girolamo, for Spakianos, submitted her client was only armed with a knife for “self defence” but on Tuesday, Judge Tracey said that made the offending “even more frightening” given it wasn’t premeditated.

“It was no doubt an incredibly frightening experience for Mr Wimshurst, and the physical, psychological and financial effects for him and his family are ongoing,” she said.

“The attack was violent and unprovoked.”

Judge Tracey sentenced Spakianos to five years, eight months and 12 days in prison with a non-parole period of three years – backdated to June 4, 2024.
