The noise from a neighbour revving a car engine was enough to trigger a man, leading to a neck grab, punches and kicks.

Scott Robert Wallis, 45, pleaded guilty to assault occasioning actual bodily harm and appeared at Grafton Local Court on Monday.

Facts state the man from Banyabba – between Grafton and Casino – was staying with his mother at Glenfield Park in Wagga Wagga.

The pair became frustrated after the next-door neighbour “revved” his car as he worked on the vehicle.

Wallis approached the neighbour, grabbing him around the neck and pushing him up against a car, before unleashing a series of punches to his face.

Wallis then kicked the victim in the ribs, according to police.

Five minutes later, Wallis went back and told the victim he was “sincerely sorry”.

Wallis made admissions to police and said he “saw red” after the victim allegedly swore and yelled at his mother.

Magistrate Juliana Crofts said the assault was a “serious example of violent behaviour”.

“It’s not the way to behave – even with the circumstances,” Ms Crofts said.

Defence lawyer Greg Coombes said Wallis and his mother were having a bad day prior to the incident.

“It’s a response to emotions he was feeling and he felt protective instincts toward his mother,” Mr Coombes said.

The court heard Wallis had a short criminal record and several references spoke highly of him.

“People who know him say it’s out of character,” Ms Crofts said.

Wallis was convicted and sentenced to a community corrections order for 12 months.

Ms Crofts handed him a stern warning.

“If you breach this by committing another offence of any type, you’ll be brought back before court and sentenced,” she said.
