Malachi Freeburn faces Ballina court after breaking man’s nose in Evans Head on New Years Day

Police discovered a man sprawled against a fence beaten and bloodied after a nasty New Year’s Day confrontation in Evans Head, a court was told.

Police discovered a man sprawled against a fence with his nose broken and blood spread across his face after a New Year’s Day confrontation in a northern NSW tourist town.

Malachi Freeburn, 19, was walking along Park St in Evans Head with the victim from Casino about 3am on New Year’s Day, January 1, a court was told.

Freeburn was called a “mother-fu--ker“ and responded by punching the other man in the face

“Freeburn punched the victim in the face, causing him to fall to the ground in pain,” according to police facts.

Police found the victim lying on the ground against a metal fence with his face covered in blood, nursing a broken nose.

“His nose was heavily bleeding with red marks around it,” facts stated.

Paramedics arrived, but the man refused to be taken to hospital.

Earlier in the night, Freeburn was taken into custody after he was caught “with numerous alcoholic beverages sticking out of his pockets” in an alcohol-free zone.

Freeburn ran when police tried talking to him.

“While running from police Freeburn fell over, giving police enough time to catch up with him,” according to the facts.

The drinks were removed from his pockets while he was on the ground.

Freeburn then stood up, shoved a police officer and was hit with capsicum spray before he was taken to Evans Head Police Station.

He apologised to the officer, was released from the station and then broke the man’s nose.

Freeburn pleaded guilty to assault occasioning bodily harm, assaulting a police officer and resisting a police officer when he faced Ballina Local Court on February 2.

The case has been adjourned to February 23.
