Charlotte Ruth Kiss Mola pleads guilty to failing to give way at Mullumbimby intersection

A Mullumbimby P plater’s van flipped after the young driver failed to give way at an intersection.

The “traumatic event” saw Charlotte Ruth Kiss Mola, 22, plead guilty at Mullumbimby Local Court on Wednesday to failing to give way.

Agreed police facts tendered to court state Mola didn’t give way to a car at the Stuart St and Fern St intersection about 11.45am on August 6 last year.

“This resulted in a Blue Toyota RAV4 travelling eastbound along Fern St crashing into the back of (Mola’s) HiAce van causing it to flip onto its off-side,” police facts state.

Mola had a passenger in the car at the time however there were no serious injuries.

Defence lawyer Mark Swivel said the crash was a “traumatic event” for Mola.

“The nature of how the (crash) happened is unclear, she stopped for a while … the other car must have been travelling at some speed,” he said.

“The other car clipped the left rear of her car causing it to turn over … she had a passenger at the time.”

Magistrate Karen Stafford said the crash was caused because Mola did not give way to the other car.

“You can clearly see the sign on the road. I accept you stopped for a while but I’m not here to judge the act of another vehicle,” she said.

“You put yourself and your passenger at risk.

“Your traffic history isn’t good and you were on your ‘P’ plates when the crash occurred.

“Having read your letter to the court I’m not satisfied “you are genuinely remorseful … I know you are a great volunteer with good references.

Ms Stafford convicted Mola and fined her $300.
