A northside mum spat in the face of a pub manager after she was offended at what the woman allegedly said about her high-needs children.

In July, Erin Louise Rigby and a group of others attended the Petrie Hotel.

A court heard Rigby went to the bar and got into an argument with the venue manager after that woman made “insensitive comments” about Rigby’s two children.

Rigby, 37, leant over the bar and spat in the other woman’s face before Rigby and her group left the pub.

Police attended Rigby’s Bray Park home where she declined to be interviewed but told police going to the hotel “was not a good experience”.

Rigby pleaded guilty at Pine Rivers Magistrates Court to assault.

The court heard Rigby’s two children had high needs and could be difficult to control.

Rigby’s lawyer Kerala Drew said her client knew her actions had been “a completely disgusting act”.

Magistrate Trevor Morgan said although he understood the venue manager had made insensitive comments that did not excuse Rigby spitting on her.

“My assessment is that Ms Rigby’s children have conditions that readily affect their behaviour and the venue manager, probably being unaware of that, responded to their behaviour by making insensitive comments,” he said.

“A parent is entitled to be protective of their children. But spitting on the venue manager takes it to an entirely different level.

“She might have acted poorly but to spit on her is entirely inexcusable.”

Mr Morgan dismissed Ms Drew’s calls for Rigby to be issued with a fine and sentenced her to three months prison, suspended for the next 12 months.
