A Darling Downs woman with no criminal history has fronted court for the first time after she kicked off at police during a night out in Gladstone.
The aged care worker, Shiana Marie Himstedt, appeared at the Toowoomba Magistrates Court on Tuesday, July 15, and pleaded guilty to assaulting multiple police officers while drunk in public, urinating in public, causing a public nuisance, and not following officers’ orders.
The court heard the 26-year-old mother had a blood alcohol reading of .170 when the incident took place near the Mieplace Niteclub on April 13, 2025.
Police prosecutor Chris Willson said Himstedt and her friends had been removed from the nightclub before the offending occurred about 1.30am.
Senior Constable Willson said during a street disturbance, Himstedt openly urinated in front of passing cars while squatting next to a parked car.
He said police warned a heavily intoxicated Himstedt if she did not leave the area, she would be arrested, however while the woman’s friends were forcing her to move along, Himstedt began abusing the officers.
An altercation between the group and police ensued after Himstedt was informed she was under arrest, with police being forced to deploy capsicum spray, as Himstedt’s friends tried to intervene.
Senior Constable Willson said Himstedt kicked out at and struck officers while resisting arrest.
The court heard the behaviour was out of character for the young woman, who was extremely remorseful and had never been before the courts before.
Himstedt was sentenced to complete 50 hours of community service, under which she will be subject to parole for 12 months.
No conviction was recorded
