A Northern Rivers driver who repeatedly got behind the wheel while disqualified was arrested after a court no-show, claiming he believed the court house was “shut for repairs”.

Upper Crystal Creek man, Samuel Mark Davison, 39, appeared in a blue flannel shirt before Magistrate Gregory Grogin on Monday via audio visual link from Tweed Heads Police Station in the Bail Division court.

Davidson was charged with and found guilty of two counts of driving a motor vehicle during a disqualification period, after failing to appear in Murwillumbah Local Court on Friday.

Magistrate Lucas Swan heard and determined the matter in Davison’s absence and issued an arrest warrant.

Davison said the courthouse was “shut for repairs” when he failed to appear.

Upon his arrest, Davison denied not attending, claiming he “wasn’t aware” of the July date and only had knowledge of court dates listed for January.

“So, the 22nd of May, he was on bail for drink and drive, is that correct?” Mr Grogin said.

“Yes that’s correct,” defence solicitor Christopher Davis said.

The court heard Davison had a history of failing to appear, domestic violence, low and mid-range drink driving, property matters, driving while suspended and a series of prior warrants.

Police prosecutor Sergeant Velkovska asked the court for seven-day police reporting and a surety to “ensure he attends his next court appearance”.

“He’s got a record of failing to appear, breach of bail in both Queensland and NSW,” Mr Grogin said.

“If you fail to appear on the next occasion you’ll be before me and bail will no doubt be refused.”

Davison was granted strict conditional bail and must report to police daily and cannot occupy the drivers or riders seat of any vehicle.

Davison is due to face Tweed Heads Local Court for sentencing on August 4.
