Man arrested after firing gun from moving car

A man and woman have been charged after shots were fired out of a car more than 40km and five hours apart, including one allegedly captured on video and posted online.

Port Stephens-Hunter Police were investigating reports of shots being fired in the Maitland suburb of Tenambit about 9.35pm on Sunday – more than five hours after a shotgun was allegedly fired out of a moving vehicle in the western Lake Macquarie suburb of Toronto.

The footage, obtained by 2GB, allegedly shows a man firing a shot from the window of a moving car while driving through Toronto.

After one shot is fired, the man is heard saying, “whoops.”

Police say the video was brought to their attention late on Sunday evening by a member of the public.

Just after 2.30am the following morning, police said in a statement that they were “making enquiries” into a vehicle on Burley St at Tenambit when “a man allegedly fired a shot into the air from the parked vehicle”.

A police helicopter was used to help track the car to a home on Coal Point Rd at Coal Point, a suburb immediately south of Toronto and 40km away from Tenambit.

A perimeter was established around the property by local police with support from specialist officers from the tactical operations unit.

Several hours later, about 5.15am, police arrested 26-year-old Brandon Rogan at the home.

“During a subsequent search of the home and property, officers allegedly located and seized a firearm, ammunition, and a replica pistol,” police said in a statement.

“Inquiries established that the man was disqualified from driving in NSW and was subject to a Firearms Prohibition Order.

“It will also be alleged that man did not have permission from the owner to drive the vehicle.”

Rogan was charged with 11 offences including three counts of firing a firearm in or near public place (three counts), and one count each of taking and driving a conveyance without consent of owner, possessing an unauthorised prohibited firearm, possessing an unauthorised pistol, possessing ammunition without holding licence/permit/authority, using a prohibited weapon contrary to prohibition order, acquiring etc ammunition subject to prohibition order, driving a motor vehicle during disqualification period, and driving recklessly/furiously or speed/manner dangerous.

He faced Toronto Local Court on Monday where magistrate Peter Barnett sent the Lake Macquarie man to a mental health facility for assessment.

O’Connor was charged with concealing serious indictable offence (10 year maximum) of other, and goods in personal custody suspected of being stolen (motor vehicle).

She faced Toronto Local Court where she was not required to enter a plea and did not apply for bail before her case was adjourned until Tuesday.

Police said there were no reports of any person being injured or any property being damaged.
