A fed-up police officer shattered a car window with his bare hands after a ‘sovereign citizen’ refused to acknowledge his authority during a highway intercept.

Police asked Helen Mary Delaney, 52, to exit her vehicle on Wednesday afternoon after she allegedly failed to provide personal details.

She argued she was not driving, she was “travelling” and therefore police had no jurisdiction to stop her.

The woman’s partner filmed the entire incident on his mobile phone, interjecting throughout the conversation with officers on the Pacific Highway in Coffs Harbour on January 18.

“I’m not in your jurisdiction,” they both said to police.

Police allege Ms Delaney was wanted on two outstanding arrest warrants for domestic violence-related offences.

Ms Delaney has since faced Coffs Harbour Local Court where she has been banned from driving any vehicle.

She also must comply with the apprehended violence orders she is alleged to have breached and cannot enter six NSW towns.

The video begins shortly after highway patrol pulled Delaney over about 1pm.

“Can you explain how we’re in your jurisdiction? We're not driving – we’re travelling,” the man filming asks police.

The pair then asked for a higher ranking officer before asking who they swore allegiance to.

“You’ve got no jurisdiction here, bruz,” the man is heard to say in the video.

“Who do you derive your authority from? Who have you sworn an oath to?

“There is no Queen of this country.

“Don’t you dare think you have authority here.”

The police officer tells the car’s occupants he will break the window if they do not comply with his directions.

“You are going to be held liable brother,” the man said.

After several warnings, the fed-up officer then ripped the window out with his bare hands before arresting the woman.

“You’re a f---ing prick – I’d love to just get you one-on-one – I would f---ing drive you,” the man says.

Police allege the car’s registration expired in July last year.

Ms Delaney was eventually arrested and failed to take a breath test.

She was charged with the outstanding warrants, driving an unregistered vehicle, driving an uninsured vehicle, refusing to produce a driver’s licence, state name or address, and refusing or failing to submit to breath test.

Ms Delaney was granted bail after appear at Coffs Harbour Local Court on Thursday but she must report to Ballina police three days a week and cannot drive any vehicle.

She also cannot enter Falls Creek, Tomerong, Basin View, St George’s Basin, Huskisson or Worrowing Heights.

Former NSW magistrate David Heilpern recently said that over his years in Australian courts, he heard the arguments of “hundreds” of so-called “sovereign citizens” – but not one ever held up.

As Dean of Law at Southern Cross University, it is his well-researched understanding that a sovereign citizen has never successfully proven why they are immune from the rule of law in an Australian court.
