Surge in sexual assault reporting as public discussion around rape increases

A Moreton Bay man has been jailed for raping a woman three times in the space of 20 minutes.

Caboolture man Nathan John Stolberg, 43, pleaded guilty in Brisbane District Court on Thursday to three counts of raping a woman more than 15 years his junior and damaging her fridge.

The court heard the offences occurred about 6pm on November 30, 2016, in the woman’s unit at South Brisbane.

Stolberg, who the court heard was an alcoholic who had been drinking heavily that day since he woke up at noon, told his victim, then aged in her early twenties and with an intellectual disability, upon his arrival at her residence, “We both know why I’m here”.

He then raped her three times over a period of about 20 minutes despite her physical attempts to resist him and her repeated requests to stop.

After he showered, he told her he felt “really bad”, the court heard.

The woman immediately reported the rape and Stolberg was charged shortly after.

The lengthy delays in the case were through no fault of Stolberg’s.

He was remanded in pre-sentence custody in November last year.

It was accepted by the prosecution his intoxication was such that he was “unable to properly assess (his victim’s) consent” and that he could not remember the offending.

It was submitted on Stolberg’s behalf that his alcoholism had exacerbated a severe personality and mild neurological disorder.

Furthermore, the court was told Stolberg had a difficult upbringing and a history of low-level criminal offending.

Stolberg, a father-of-six, faced various periods of homelessness due to his personal issues, the court heard.

He was sentenced to five years’ imprisonment, which will be suspended after he has served 16 months, on March 10 next year.

Stolberg was also placed on three years’ probation.

According to his Facebook profile, Stolberg was educated in the Gympie region and has previously lived in Logan.
