Police will allege the man raped a homeless woman in a park at Cavill Avenue in the early hours of Wednesday morning.

Police were called to the scene about 5.45am.

The man cannot be named under Queensland law which prohibits the identification of people charged with sexual offences until they are committed to trial or plead guilty.

Ms Clark asked for a brief of evidence to be compiled.

Magistrate Cameron McKenzie ordered the brief be compiled by June 17.

The matter will return to the Southport Magistrates Court on July 1.

The Bulletin can reveal that the man was charged on February 18 with three counts of rape alleged to have occurred in Macintosh Park, Surfers Paradise on February 17.

He was also charged with three counts of assault with attempt to commit rape and sexual assault.

The February incident is allegedly to have involved a different woman than the incident on Wednesday morning.

Magistrate Pamela Dowse gave the man bail on February 22.

A part of those bail conditions were that he not leave his home between 5pm and 6am.

Those matters will return to court on May 13.
