Luke Tomlinson refuses to speak without his lawyer in Southport court

The son of a wealthy Gold Coast businessman has refused to speak until he meets with a lawyer during a brief appearance in court.

Luke Tomlinson, who lost his leg after being shot in July 2018, has been in custody on remand for at least a week after being charged with serious assault, public nuisance and failing to appear in court.

On Friday morning, Tomlinson told officers at the Brisbane Correctional Centre that he would not leave his cell.

The court was told he had also refused to leave his cell for court a week earlier on February 25.

Officers managed to convince him to come into the video booth for an appearance in the Southport Magistrates Court.

He was in a wheelchair, shirtless and had a hospital gown draped over his shoulders.

Mr Tomlinson told Magistrate Dzenita Balic that he refused to speak until he had his solicitor.

Prosecutor Chris Freeman said it was the first time Tomlinson had mentioned he had a solicitor or wanted to speak to one.

Tomlinson then declined to answer whether he wanted to apply for bail.

“I’ve done nothing wrong, I’m not on bail,” he said.

Mr Freeman said he would contact the solicitor Tomlinson had named.

Magistrate Balic adjourned the matter until next week.

While the matter was adjourned Tomlinson was heard mumbling: “Bullshit, bullshit, bullshit”.

When Tomlinson was shot he had long, curly hair and a long, bushy beard. He has cut his hair short and removed his beard.

He kept his face in his hands for a majority of the appearance.

During the robbery attempt Tomlinson was bundled into a car at Helensvale.

He was shot in the leg. It was amputated in hospital.

Nicholas Alexander Bayton pleaded guilty at the end of last year to grievous bodily harm and armed robbery.

He was sentenced to five years’ prison, which was immediately suspended.

Tomlinson is the brother of entrepreneur Sean Tomlinson, who rocketed into the BRW rich list in 2016 with a fortune exceeding $150m, and the son of Owen Tomlinson, the co-owner of now defunct basketball team Gold Coast Blaze.
