A Logan florist has faced court after he was caught filming a man’s genital area in a shopping centre toilet.
Haliya Lim, 30, pleaded guilty in Beenleigh Magistrates Court on June 19 to one count of observations or recording in breach of privacy - genital or anal region.
The court heard that on July 2 last year at the Hyperdome Shopping Centre, Mr Lim was in a toilet cubicle at the centre.
He took out his mobile phone and snuck it under the adjacent cubicle and began filming the man’s genitals, the court heard.
Mr Lim’s recording was noticed by the victim and police were notified, with Lim arrested, the court was told.
Mr Lim, who emigrated from Cambodia in 2022, worked as a florist and had no criminal history.
Police prosecutor Sergeant Cody Jones said it was very serious offending and a probation order would be an appropriate sentence.
But Mr Lim’s lawyer said the offending was unsophisticated, opportunistic and came from an emotional place due to Lim’s struggles with his sexuality.
Mr Lim was supported by family members in court.
Magistrate Michael O’Driscoll said he noted the five character references placed before him and Mr Lim’s genuine remorse.
“I accept that you are embarrassed by your conduct,” he said.
Mr Lim was sentenced to a 12-month probation order and no conviction was recorded.
