Bail for Logan man accused of raping daughter

A Logan man who allegedly raped and indecently treated his daughter for four years, and was a registered sex offender until recently, has been released into the community on bail.

A Logan man who is accused of raping, indecently treating, and attempting to rape his daughter multiple times over four years has been released on bail.

The man, who cannot be named to protect the identity of his alleged victim, did not appear but had his matter heard in Beenleigh Magistrates Court on Tuesday, July 12.

The 44-year-old stands charged with 11 counts of indecent treatment of a child under the age of 16, two counts of rape, and one count of attempting to commit rape.

It is alleged he offended between December 2017 and February this year against his biological daughter, who is now 14 years old.

Police prosecutor Tim Wise said he allegedly inappropriately touched the young girl and raped her.

He noted the girl had provided specific details that tied the alleged offending to particular events, times, and dates that were corroborated by her mother.

Mr Wise said the matter would have to go to District Court for trial and the man, if found guilty, would face a term of imprisonment of between seven and eight years.

He was sentenced in 2013 to 3.5 years’ imprisonment for “a number of attempted child stealing-type charges”.

The court heard the man had spent 125 days in custody by Tuesday and was a registered sex offender until March this year.

Defence lawyer Bruce Affleck said his client’s daughter – his alleged victim – lived with him 50 per cent of the time between 2017 and last year.

He argued the strength of the evidence against him boiled down to the girl’s version of events.

“My client has provided instructions which (speak) to the motivations for the complainant being untruthful,” Mr Affleck said.

“They’ll be ventilated in the trial which I won’t raise here.”

He said the man had employment to return to upon his release and would live with a friend, also at Logan.

Magistrate Michael O‘Driscoll acknowledged the charges would be contested and the matter would need to go to a higher court.

He also noted the man’s application for bail was opposed by Mr Wise.

Mr O’Driscoll released the man on bail on strict reporting, non-contact, and residential conditions, also ordering he wear a tracking device.

The matter will return to Beenleigh Magistrates Court on August 31.
