A Gold Coast man who assaulted a tram worker in a vile attack has faced court after a second attack on another rail employee just months later.

A Gold Coast man who assaulted a tram worker in a vile attack has escaped conviction again after a second attack on another rail employee just months later.

This was despite the 20-year-old being warned by a magistrate that he was on his “last chance” after the first assault.

Sean Bradley Joseph pleaded guilty to five charges, including serious assault of a person over 60, wilful damage and unlawful use of a motor vehicle, in Southport Magistrates Court on Monday.

The court was told Joseph punched the hand of a tram worker, who was aged in their 60s, after the worker asked him to get off the tram due to not having a ticket.

The tram worker reported the June 11 assault to police later that night.

It was the second time Joseph had attacked a Gold Coast tram worker in just six months.

He was sentenced in the Southport Magistrates Court in May after he threw a drink on a light rail employee in a separate incident.

During that sentencing, Magistrate Mark Howden warned Joseph: “If you’re going to behave like this in the future, you’re going to have convictions recorded.”

On Monday, Magistrate Joan White placed Joseph on a nine-month probation order for the second assault and ordered him to pay $400 compensation to the victim.

Magistrate White said she would not record a conviction due to Joseph’s limited history and age.

On Monday, the court was told in a separate incident on September 4, Joseph kicked and broke the glass panel of a bus window after the driver refused to let the 20-year-old ride the bus while drinking alcohol.

The court was also told that later that month in another incident, the 20-year-old was involved in the theft of a car from a home in Clear Island Waters, which he later crashed.

He did not have a licence at the time.

Joseph’s solicitor, India Brady, said her client had been diagnosed with autism spectrum disorder, attention deficit disorder and anxiety as a young child.

“When he turned 18, he started using alcohol,” Ms Brady said.

“The offending occurs in the context of daily alcohol consumption.”

Joseph was disqualified from driving for two and a half years for the driving charges.
