Former Black Uhlans bikie Steven Edward Smith and brother Wayne George Smith sentenced for punching drunk driver

A former Black Uhlans bikie and his junior football coach brother have been sentenced for revenge crimes on a drunk driver after they crashed into one of their wives.

A Former Black Uhlans bikie and his junior football coach brother punched a drunk driver repeatedly in retaliation for a crash involving one of their wives.

Steven Edward Smith and Wayne George Smith punched Anthony James Everleigh in separate attacks after the crash in Highland Park on June 20, 2019.

Mr Everleigh – who had a blood-alcohol reading between 0.149 per cent and 0.24 per cent at the time of the crash – had an ear torn to its canal, a ripped nose bridge and cut to his lip needing sutures.

Steven Smith, 36, pleaded guilty in the Southport District Court to common assault.

Wayne Smith, 33, pleaded guilty to assault occasioning bodily harm.

Judge Geraldine Dann sentenced Steven Smith to four months’ prison, with immediate release on parole.

Wayne Smith was sentenced to 18 months’ probation and fined $3000. No conviction was recorded.

“Vigilante responses are not acceptable,” Judge Dann said.

“It’s not the way mature people in a civilised society respond to incidents such as these.”

The court was told Mr Everleigh crashed into a car driven by Wayne Smith’s wife, Teagan Smith.

Ms Smith attempted to call her husband but when he did not answer her brother-in-law was contacted.

When Steven Smith arrived, he got into an argument with Mr Everleigh about providing his name.

Steven Smith then punched him twice in the head before driving off.

He told Mr Everleigh: “Just wait until my brother gets here.”

Wayne Smith arrived minutes later and unleashed a “flurry of punches” on Mr Everleigh.

The driver was punched about five or six times.

Steven Smith’s barrister Martin Longhurst, instructed by TWC Lawyers, said Mr Everleigh was “off his head” when his client arrived.

He said Steven Smith “made poor decisions” but had some insight in realising that he needed to remove himself from the situation.

The attack came less than 12 months after Steven Smith stabbed millionaire Paul Picone in a Gold Coast park.

In June last year he was sentenced to four years in prison and released on parole in February this year.

Wayne Smith’s barrister, Justin Thomas, instructed by Howden Saggers Lawyers, said his client had no criminal history and worked up to 15 hours a day as a truck driver.

He said it was an “over-reaction” to seeing his wife in distress.

“His recollection (after hearing about the crash) is jumping out of bed, throwing on a pair of shorts and hitting the road as soon as possible,” Mr Thomas said.

The court was told Wayne Smith coached junior rugby league and in 2019 was won Coach of the Year.
