Parents sue Warner Bros after Harry Potter replica wand ruptured 3yo’s eyeball

A mum has filed a lawsuit against Warner Brothers after her three-year-old son allegedly suffered a horrific injury from a Harry Potter replica wand. 

Jessica Perry bought her two sons a light-up replica Harry Potter wand pen featuring a brown pen and decorative cap. 

The boys loved it and instantly began playing with their new toy. Just like in the film and book series, they began practising their magical capabilities by waving the replica wand around and pointing at each other.

Toddler nearly blinded after replica wand pen “ruptured his eyeball”

When her eldest son, who is of primary school age, flicked his wrist while holding the wand, the pen part ejected from its cap and hit his three-year-old brother, Hunter, in the eye.  

According to the lawsuit, the pointy end of the pen “ejected from the hilt/cap, flew across the room, and pierced Hunter's left eye, rupturing his eyeball and causing his inner eye fluid to spill out and run down his cheek.” 

The mum claims the toddler nearly went blind as a result, having to undergo “an intense and painful” eye surgery. Hunter’s retina remained unstable, she claimed, forcing him to “'undergo a second painful surgery to stabilise it,” TMZ and The Blast reported.  

She attached photos to the court documents showing her son’s horrific injuries. Following the surgeries, she said her son was traumatised by the after-effects of his injuries, including “medications administered to his eyes that caused him to scream in agony and beg his parents to stop.” 

The toddler’s horrific injuries have distressed him so much that he “cannot sleep unless he has full lighting in his room” and can no longer play sports or roughhouse as they guard against further retina damage. 

“Even with this treatment, Hunter’s life will never be the same, as he has to protect his affected retina from coming loose again,” Perry said.

“Instead, he lives in post-traumatic fear that has affected every aspect of his life. He now seeks redress for his physical and psychological injuries.”

Replica wand pen “worst design ever for a child”

Perry is suing Warner Bros. Entertainment, Inc. and Warner Bros. Discovery Global Consumer Products, Inc. for $8 million in damages for her son’s injuries, emotional distress and punitive damages. 

The lawsuit argues the wand was defective, and Warner Bros should have been aware of the problem, as this was not the first time the wand had caused issues. 

A 2019 online review of the same replica wand pen issued a similar warning after the pen “almost killed” a mum, allegedly hitting her in the head after it ejected from its cap.

“Worst design ever for a child,” the review said. “I gave [it] to my seven-year-old … He goes to wave it because that’s what you do with wands, and this heavy piece (I guess you could call it the pen cap) flies off and hits me in the head. It hurt so bad I thought I had an aneurysm.”

“I suppose it would work well with your enemies but clearly my child is out of his league with this pen.” 

Warner Bros is yet to respond to the lawsuit.
