Uber Eats driver Gurprit Singh bailed on Hungry Jacks sexual touching charges

An Uber Eats delivery driver accused of sexually assaulting a teen in the toilet block of a Western Sydney Hungry Jacks will defend the allegations in court, claiming he did not know the employee was underage.

An Uber Eats delivery driver accused of sexually assaulting a teenage employee in the toilet block of a Western Sydney Hungry Jacks will defend the allegations in court, claiming he did not know the girl was underage at the time.

Indian national Gurprit Singh, who has been in Australia since January 2023 on a student visa, was waiting to collect an order at the food outlet on the morning of July 12 last year when he allegedly followed the 15-year-old girl into the women’s toilets.

According to court documents, Singh manoeuvred his way into the cubicle she had entered and locked the door behind them before allegedly forcing himself upon her.

Police will allege the 31-year-old started rubbing his penis against the girl’s right leg to the point of ejaculation, before kissing her and biting her on the lip, despite her allegedly telling him “no” multiple times.

It is alleged Singh stopped and apologised to the girl, who unlocked the door and pushed past him.

The court heard she left the bathroom and rushed back to her colleagues, at which time she appeared “visibly distraught”.

Singh then left the restaurant “in a hurried state”, police allege.

The teen reported the incident to police, who arrested Singh later that day.

However, when interviewed, Singh denied assaulting the teen, instead claiming she had been the instigator of a consensual sexual encounter.

It is alleged Singh told detectives the girl had “gestured for him to come into the bathroom” with her and asked if she could perform fellatio on him.

The court heard he further claimed he had allowed the sexual act to occur for approximately two minutes, causing him to ejaculate, however he then told the teen to stop, which he claimed had upset her and she “angrily left the bathroom”.

Singh was charged with two counts of intentionally sexually touching a child under 16 years and remanded in custody.

During a bail hearing in the NSW Supreme Court in December, Singh’s lawyers told the court their client had pleaded not guilty to both charges and would argue at a Local Court hearing that he did not know the girl was under the legal age of consent at the time.

They further argued the girl’s “credibility” would be closely scrutinised during the hearing, alleging she had failed to disclose in her police statement that she had “gestured for Singh to follow her into the bathroom”.

They claim the gesture was “clearly evident” on in-store CCTV footage produced by Hungry Jacks and cast doubt over her version of events.

Prosecutors opposed Singh’s application for bail, raising concerns he could flee the country if released from custody.

They conceded his proposal to live with his cousin in Griffith, in southern NSW, would put him some distance from the alleged victim, but argued other young women might be put at risk if Singh continued to work as an Uber driver.

Judge David Davies agreed to release Singh on strict bail, which includes a home detention condition, daily reporting to police and a prohibition on being in the company of anyone under the age of 18.

Under the terms of his bail, Singh is not allowed to work as a delivery driver.

The case has been set down for a hearing in July.
