Tom Richard Brockley caught with cocktail of illicit party drugs

A labourer on a skydriving trip was caught driving while high on cocaine and meth. When police pulled him over for crossing double white lines, they got more than they bargained for.

A Victorian labourer on a skydiving trip to NSW’s south coast told police he was unaware a Pelican container stashed in his car contained a cocktail of illicit party drugs.

Tom Richard Brockley pleaded guilty at the Batemans Bay Local Court on Monday to five counts of drug supply, driving under the influence of drugs, as well as possessing prohibited drugs and the proceeds from crime.

The Ferntree Gully man was driving on Imlay St in Eden shortly after midnight on May 14 when police officers patrolling the area observed Brockley crossing over double white lines onto the opposite side of the road.

“Police conducted checks on Brockley which revealed a considerable history in Victoria of drug-related offences, and formed the suspicion he had drugs on his person,” police facts read.

“Asked if he had any drugs in his car, Brockley handed police a small container, saying: ‘Just this’.”

Brockley, 37, told officers the container, labelled Aspen Dexamphetamine, was treatment for attention deficit hyperactivity disorder.

In total, police found inside 14 tablets and capsules varietals of the controlled substance.

Labelling on the bottle listed an address in NSW, not Victoria where Brockley also worked as a labourer.

A police search of the vehicle uncovered a further stash of party-type drugs and hallucinogenics in a yellow Pelican container, which had been wrapped in a jumper and stashed under the front passenger seat.

Five illicit drugs were found inside, including 19.39g of MDMA, 14g of cocaine, 0.41g of dimethyltryptamine, 12.5g of ketamine and four pieces of multi-coloured cardboard containing LSD.

The amounts of MDMA, ketamine, and cocaine all exceed the indictable quantity under law.

Police also found a set of small scales, small plastic bags, and $5860 in cash.

Brockley told police he owned the container, but told officers he was unaware of the drugs inside.

He tested positive for cocaine and meth after a roadside test.

Brockley was placed under arrest and taken to Bega Police Station.

During an interview with police, Brockley told officers he had “no comment” when asked about the drugs.

A full check of Brockley’s criminal history revealed 96 separate charges in Victoria, primarily for drug offences.

Solicitor Lisa Stone told Batemans Bay Local Court her client did not appear in-person because he was ill.

She said he was prepared to enter guilty pleas for all offences despite a dispute over the charges.

“Brockley is happy to plead guilty even though there was someone else in the car,” Ms Stone said.

“Considering, also, that the charges are for supply when it should just be possession.”

Ms Stone further contested the amount of DMT found (0.41g) fell under the threshold of supply.

Brockley had previously pleaded guilty to three of the charges, but withdrew those pleas following a disagreement with police over the withdrawal of one of the charges. That charge has since been removed.

“It’s all a bit of a mess,” Ms Stone told Magistrate Doug Dick.

“We withdrew in a bit of a fit.”

Brockley will return to Batemans Bay Local Court on November 14 for sentencing.
