A Sydney couple who engaged in “safe choking” and role-play during sex - and sold their raunchy videos online - are embroiled in a criminal court case as the ‘submissive’ partner faces intentional choking and rape charges.
The 23-yr-old father, who cannot be named for legal reasons, has been accused by the self-confessed “dominant” female partner of trying to suffocate their 10-month old son and choking and raping her in February last year.
The man, represented by high-profile, ‘Lambo Lawyer’ Peter Lavac, has pleaded not guilty to three charges of intentionally choking and four charges of rape.
The Penrith District Court has heard the man and women, who were originally “friends-with-benefits”, made cash from selling their bondage-style sex to paying viewers online.
“You will also hear as part of their private sexual relationship and as part of their business, these videos would sometimes include things like consensual, safe choking, the use of bondage and restraints, mouth gags and spanking,” the Crown Prosecutor told the court.
The woman, 25, had not used their safe word “peach” when the man asked if she was consenting, before the alleged sexual assault, the court heard.
Photos taken by police of the couple’s room show costumes, wigs, equipment for live-streaming and “other paraphernalia”, the court heard.
Issues arose between the pair when the woman fell pregnant and gave birth to their baby boy in 2019.
The woman told the court one night the man cupped their son‘s mouth on-and-off until his face went red and he made crying sounds.
He told her: “It’s fun to watch you panic”, she told police in a video played to the court.
The woman told the court the man was offended in the early hours of Sunday, February 2, when she got up to sleep on the couch, because she was too hot in bed.
He proceeded to rape her from behind, while she protested and said, “no”, then he choked her with her arms until she struggled to breathe, she told the court.
“I felt genuinely terrified for my life. I have never genuinely not been able to breathe so that was a very scary feeling,” she told the court.
The woman said she gave him oral sex - while he gripped strands of her hair - and told him, “Yes, I do enjoy this”, after he asked her to say it, because she was scared.
“If I didn‘t say those things he said he would then insert his penis into my bottom...I was afraid of him and how strong he was and how he was so easily able to hold me down,” she told the court.
She said he again choked her in front of the man’s mother later that morning.
The Daily Telegraph was ordered to leave the court by Judge Sharon Harris before the woman was cross-examined on the couple‘s business by Barrister Mr Lavac.
The judge has the power to close the court to journalists and the public when an alleged sex assault victim gives evidence.
A jury of seven men and five women have been tasked with deciding if the man is guilty after hearing evidence in the seven-day trial.
The trial continues before Judge Harris on Thursday.
