The government is being urged to go back to court to lock up one of the state’s most notorious serial rapists as he continues to defy the toughest supervision orders the state can impose.

Labelled a “sexual sadist” by a psychiatrist, the man, 70, who cannot be identified because a judge ruled it would hurt his rehabilitation, is back behind bars bail with refused after his latest alleged sex attack.

The alleged attack on a 20-year-old woman in Sydney’s Haymarket last weekend is the second time the man, who has been working as a forklift driver, has breached successive extended supervision orders imposed on him by the Supreme Court since his release from jail in 2015.

The first time was in 2018 when he was sentenced to a 15-month good behaviour bond for kissing and touching a shop assistant and jailed for four months for breaching the ESO.

The same day he was charged with assaulting the young woman, he was found by his supervision officer to have a sex worker in his house, against ESO conditions. He had bought her flowers. The woman was unaware of his shocking criminal history.

The latest ESO was imposed in October 2020 and required him to wear a tracking bracelet as well as limiting access to mobile phones and the internet. It is due to run out in April and the government is being urged to seek a continuing detention order before then which would keep him locked up.

“Purely and simply for the safety of the community, this man should be made subject of a CDO,” victims’ advocate Howard Brown said.

“Clearly he cannot comply with the terms of an ESO and the bottom line and the basis upon which you make this application for a CDO is that you put the welfare of the community above the rights of a consistent offender.”

He would join an elite group, with five sex violent offenders currently in custody on CDOs or interim detention orders, including another serial rapist, Wayne Wilmot, whose victims include Janine Balding.

There are 118 offenders on ESOs including 39 in custody.

NSW Shadow Police Minister Walt Secord, who has called on Premier Dominic Perrottet to undertake a formal and wide-ranging review of state’s suppression laws in relation to serious criminal cases, also urged the government to consider seeking a CDO.

“Sadly, the legal system under Dominic Perrottet seems to be tipped in favour of the accused rather than the victim or the wider community,” Mr Secord said.

A psychiatrist has diagnosed the man as a “sexual sadist”, the Supreme Court has been told.

Central Local Court was told last week that the man is expected to enter a plea to the latest charge of sexually touching another person without consent when he next appears on February 2. There was no indication if he will apply for jail.

The Department of Communities and Justice confirmed the man remains subject to an ESO which has been suspended since his arrest and will be reactivated on his release.

The spokeswoman said a recommendation would be made to Attorney General Mark Speakman as to whether an application should be made to seek a further order under the Crimes (High Risk Offenders) Act before the current order ends”.
