Two NSW Police officers who had sex with a Sydney schoolgirl after one of them met her while working have officially left law enforcement.

James Delinicolis, 30, and Angelo Dellosa, 31, both pleaded guilty to misconduct in public office over the 2020 incident with the 17-year-old, known only by the pseudonym Violet.

Delinicolis, who had first approached the girl at a suburban train station, was sentenced to a two-year intensive correction order while Dellosa was handed an 18-month community corrections order last December.

Confidential can reveal the pair have both since resigned from NSW Police. They had been suspended without pay following their arrests.

Delinicolis gave evidence during the pair’s sentence hearing and told the court that what would happen to him could depend on the outcome of his criminal proceedings.

“That’s what the commander said when I last spoke to him about one month ago,” he said.

The court heard he has been performing lawn mowing and labouring after being charged.

Delinicolis, who has been living with his grandmother, has since split with his wife but Dellosa’s relationship has survived.

Delossa’s defence barrister, Margaret Cunneen SC, had said her client should be punished but that he should not be sent back to jail after spending some initial time behind bars on remand.

“It’s obvious that police officers in uniform must not conduct themselves in this way, they must not trawl the areas in which they work for sexual conquests of any kind or sexual relations of any kind – this was very wrong,” she said.

Delinicolis’ defence barrister, Philip Strickland SC, similarly said his client’s risk of reoffending would be better addressed by him remaining outside with his family instead of being sent back to jail.

In sentencing them, NSW District Court Acting Judge Peter Berman said their sentences would serve as a reminder of “just how wrong it was for them to treat the privileged position of a police officer as being an opportunity to pick up a schoolgirl so they could have sex with her”.
