Sydney investor Chris Nasser will fight a police application for an apprehended domestic violence order against him to protect his estranged wife Hollie Nasser, a court has heard.

Nasser, 39, of Paddington, was mentioned in Downing Centre Local Court on Wednesday following a very public split with Ms Nasser, 36, who has since started dating his former business partner, Charlie Aitken.

Ms Nasser and Mr Aitken’s estranged wife of 19 years, Ellie Aitken, are also former best friends.

Defence lawyer Justin Wong, acting on behalf of Nasser, confirmed they would fight NSW Police’s application for the ADVO.

“It’s to be defended and we ask for a timetable of evidence,” Mr Wong told the court.

“(Nasser is) not present in court due to Covid policies.”

Deputy chief magistrate Michael Allen asked if any material related to the case was ready, but police prosecutors told him they were yet to receive any documents.

Mr Allen noted the Christmas break was imminent but said police should file their brief of evidence on the matter by January 5.

“I’ll bring the matter back on January 19, 2022, for compliance … (Nasser) is excused if legally represented,” Mr Allen said.

The court will ensure all the evidence is ready on that January compliance date before a hearing is set down later in the year.

An interim ADVO against Nasser is currently in place and, as part of that order, he must not harass Ms Nasser.

Nasser was a founding investor of the Aitkens’ investment business, Aitken Investment Management.

He previously said in a statement he denied any wrongdoing in relation to the police‘s ADVO application.

“After being deeply hurt by the deception, choices and actions of other adult parties, I am disturbed that those actions have been followed by manufactured and dishonest claims now being made about me,” he said.

“I categorically deny the allegations. They are totally baseless. It is disappointing that others are choosing to make a horrible situation for me and my children, even worse.”
