Alen Susak sentenced for child sex offences at Castle Hill, Baulkham Hills

Serial offender Alen Susak was fresh out of parole when he sent teenage girls explicit Snapchat messages and arranged to meet them for sex at a Castle Hill McDonald’s eatery and a Baulkham Hills park, flouting the child protection register rules.

The truckie appeared via video link at Parramatta District Court on Wednesday for sentencing when the court heard his previous offences, including an act of indecency in 2014 when he masturbated on public transport and when he was charged in 2016 with obscene exposure.

The “exhibitionist’s” acts landed him in jail and he signed the register in May 2020.

Judge Stephen Hanley told the court given his background, Susak should have been clear not to be in contact with the girls aged 15 and 14 or “engage in any activity” with them whatsoever” on July 29 and August 20 in 2020.

“It is disconcerting that he had been released on parole, had completed the parole and after a relatively short period of time he committed the offences.’’

The court heard how the then 32-year-old sent a Snapchat message to a 15-year-old girl under the name mickmax111 offering $100 if “you suck my d**k” before they met at the McDonald’s eatery at Showground Rd, Castle Hill, on July 29.

She performed fellatio on him for 30 seconds in the back seat of his Toyota Aurion shortly before 5.30pm with two 14-year-old friends as witnesses.

One of the friends rejected his offer to do the same because she said she had a boyfriend.

The court heard how the victim and the two witnesses revealed their ages to him at the fast-food site.

But the grub continued sending messages to the 15-year-old girl and on August 20, offered $100 for her and her friends to meet at Gooden Drive Reserve in Baulkham Hills.

Wearing their school uniforms, they met him at noon until police patrolling the reserve’s carpark saw his car, busted him and pulled the 15-year-old girl from his body.

The victim told police he asked “me to suck his d**k”, that he rubbed the outside of her leg and tried to place his hand into her underpants while they were in the car.

Cops found Susak wearing his shorts back to front, two $50 notes and men’s underpants under the front passenger seat.

He was not wearing underwear when his clothing was seized.

He was charged with having sexual intercourse with child between 14 and 16 years, two counts of failing to comply with reporting obligations and two counts of act as client with child between 14 and 18 in prostitution.

Justice Hanley said the girls were vulnerable and took the age difference between the offender and the girls into account.

He said Susak’s illicit drug habit could have impacted his offences but did not “excuse his behaviour”, noting the crimes had the potential to cause psychological damage to victims.

The matter went to trial briefly but Susak pleaded guilty on March 18 this year, which allowed him a 10 per cent discount off his sentence.

During sentencing, the court heard how Susak was born in Croatia and suffered trauma as a child after the civil conflict in which members of his extended family were killed.

He used cannabis from a young age before becoming addicted to ice and suffered depression and anxiety.

The court heard the former Carnes Hill resident showed remorse but a psychological assessment revealed he often shifted the blame on the victims.

Justice Hanley said his time in custody, through Covid lockdowns, had been onerous and he had support from a “more than loving family” upon his release behind bars.

He told the court he “could not make any positive assessment that he will not reoffend’’ but was confident Susak’s family, including his parents who attended court, would support him.

Justice Hanley credited the offender for refraining from drugs in jail because “unfortunately they are clearly available’’.

Susak, 34, was convicted and sentenced to four years imprisonment backdated from August 2020. He is eligible for parole on October 19, 2022.
