A 35-year-old part-time tradie hung his head low as he was told he would spend Christmas behind bars for numerous crimes, including sending an unsolicited picture of his genitalia to a woman he found via sales website Gumtree.
Bud Frederick Condon was supported by his fiance in Gympie Magistrates Court on Thursday, where he pleaded guilty to seven charges – four driving offences, stealing from Gympie Nextra and failing to dispose of a needle.
The most serious crime, however, was Condon harassing and sending a nude picture to a woman who was trying to sell a plant for her grandma on Gumtree.
Police prosecutor Melissa Campbell said the woman was harassed by Condon through a series of missed calls and texts.
She said the woman told Condon to leave her alone several times and even tried saying she was a man in the hope he would stop.
Despite this, Condon sent the woman a photo of himself holding his genitalia.
“It is not acceptable,” Sgt Campbell said.
The court heard Condon has committed similar offences in 2016 and 2017 including once incident where he sent an explicit message to an internet stranger which crudely referenced oral sex.
Defence lawyer Neesha Maidwell said on the most recent occasion her client had been drinking when he went searching for numbers on the internet.
She said the woman received three missed calls from Condon and a series of messages, culminating in the unsolicited photo.
Magistrate Chris Callaghan described the act as “appalling”, and told Condon he would go to jail.
Condon sentenced to nine months behind bars but will only serve three months with a parole release date of December 29, 2021.
Mr Callaghan ordered Condon to enter a good behaviour bond of $1000 for the remainder of his sentence.
His fiance sobbed in the public gallery as he was escorted out of the courtroom.
For the driving charges, he was disqualified from driving for two years.
