A former high-flying real estate agent has been sentenced for violently throwing a drink at a hotel employee and stealing an iPhone as he spiralled out of control.
Thomas Tuxworth, 37, fronted Waverley Local Court on Wednesday and was sentenced for stealing an Apple iPhone from a Telstra store, attacking a hotel employee and behaving in an offensive manner near a school at Adina Hotel at Bondi Beach, and breaking a requirement of an apprehended violence order.
According to facts tendered to court at the time the crimes were committed Tuxworth earned about $3800 per week.
About 4.40pm on June 24, 2021 Tuxworth visited the Telstra store at George St in Sydney’s CBD to buy a new phone, the facts state.
However when his credit card was declined, the property manager checked over his shoulder twice and left the store with a gold Apple iPhone XS Max 64GB.
On August 24, 2021 Tuxworth responded angrily when he was told he could not book a room because he had been barred from the ritzy Adina Hotel on Hall St, Bondi Beach.
After he told a staff member; “you’re a bunch of c**ts”, a female employee retreated behind the front counter, only to have further abuse hurled in her direction.
“You’re a fat Brazilian c**t”, Tuxworth yelled before knocking a bottle of hand sanitizer to the floor, grabbing a chair and finally throwing a cup filled with liquid at the woman, which landed on her clothing, hair and arm.
About 9pm on September 28, 2021, Tuxworth consumed a bottle of wine in the presence of a woman he was not allowed to be in the presence of while consuming alcohol; a requirement of an AVO taken out by another person who was not the woman.
Tuxworth’s lawyer James Payton told the court his client had descended into a difficult period as a result of drug abuse.
“Things went truly out of control for him,” Mr Payton said, adding he experienced regret and shame at his actions.
“No one in a public-facing role should have a drink thrown at them,” Mr Payton said.
Tuxworth has recently been discharged from rehabilitation for alcohol abuse, the facts state.
Magistrate Ross Hudson told the court his ruling must take into account Tuxworth’s successful completion of a drug treatment program and his motivation to remove drugs from his life after years of failed attempts.
The string of charges were “a looking glass into you unravelling”, Magistrate Hudson said.
“You’ve used that time [since the charges were laid] to focus on rehabilitation. Make sure you continue to do that,” he told Tuxworth.
Magistrate Hudson convicted Tuxworth of all charges and was sentenced to a 12-month community corrections order with the requirement he abstain from drugs. He was also fined $700 for offensive behaviour and breaking his AVO requirements.
