Samuel Peter Evans: Bondi Junction man charged with sexual intercourse without consent

A 22-year-old Bondi man accused of sexual intercourse without consent has had his bail varied to allow him to travel to the US for a long-planned trip with his father.

A Bondi man charged with rape has had his bail varied after his family offered a $20,000 bail surety to let him leave the country and travel to the US with his father, a court has heard.

Samuel Peter Evans, 22, of Bondi Junction, appeared at Waverley Local Court on Monday where his bail was varied.

Evans has been charged with two charges of sexual intercourse without consent. He has not yet entered a plea.

The matter was first heard at court in February 2022.

The court heard the trip to the US with Evans’ father had been planned before charges were laid against the young man.

Evans’ lawyer told the court a bail variation to allow him to go overseas should be granted because of the strong ties he had with the community and the fact he had appeared in court on Monday.

“All his family, friends, ties are here,” Evans’ lawyer said.

However the police prosecutor told the court he did not support any changes to the existing bail conditions given the serious nature of the charges.

“The accused is facing a very long sentence,” the police prosecutor said.

“Given the seriousness of the charges he is facing, there is concern that he will not return to the jurisdiction.”

Magistrate Ross Hudson noted the young man was supported by family who appeared with him in court – and they had indicated they were willing to put up bail surety of $20,000 to ensure he could take the trip.

Mr Hudson also noted the original bail conditions had not included suspending Evans’ passport.

Bail was granted to Evans under the condition he report weekly to Waverly police station, live at Bondi Junction, and not be with or contact the person named by police in the charges.

Magistrate Hudson granted the bail variation, suspending the residence order and reporting conditions for four weeks between February and March.

Under the bail conditions a person named by the court must pay $100,000 if Evans fails to comply with the orders.

The matter will return to court later this year.
