Phillip House Nursing Home Pty Ltd: Bronte boarding house approved for development

A boarding house pitched for construction next-door to an elite eastern suburbs private school has been approved for development, with almost double its initial occupancy numbers.

A $12m contested boarding house next to an exclusive private school at Bronte in Sydney’s eastern suburbs has been given the green light to proceed to development, with almost double the number of occupants.

The Land and Environment Court has upheld an appeal lodged by the developer in relation to a number of conditions attached to the Waverley Local Planning Panel’s consent of the development, including a fixed number of residents.

Plans to demolish the existing aged care facility at 319-321 Bronte Rd, Waverley, to construct a $11.7m three-storey boarding house for over-55s with 40 rooms as well as a managers unit and basement parking, were lodged with Waverley Council in 2021.

The Waverley Local Planning Panel approved the development – next door to St Catherine’s School, in February 2022, after which consent was granted by the council under the provision the facility only consisted of single occupants in self-contained rooms.

The council’s approval documents said the use and operation of the premises should comply with the requirements of government regulations, which outline the facility must not accommodate more than 41 residents including the onsite manager in the building.

“Management are responsible for ensuring the number of patrons in the premises does not exceed the approved capacity,” Waverley Council’s letter of consent states.

However the company behind the boarding house development, Phillip House Nursing Home Pty Ltd, appealed several conditions of the consent to the Land and Environment Court.

Following a conciliation conference arranged by the court, Phillip House Nursing Home agreed not to pursue changes to the conditions, except to allow 77 residents to live at the boarding house.

This will consist of 36 double occupancy rooms, four single occupancy rooms and a single occupancy manager’s room.

While the development standards of the State Environmental Planning Policy (Affordable Rental Housing) do not allow for more than one person per room in boarding house accommodation, the council and Phillip House agreed to allow it because the room size exceeded 16 sqm.

The court upheld the appeal and granted development consent for the project.

Representatives at Phillip House Nursing Home, linked to SummitCare Australia aged-care director Peter Wohl, were approached for comment.
