Paul Diks: Real estate agent charged with low-range drink driving, cocaine possession

A North Shore real estate agent busted drink driving in a white Jaguar in Sydney’s eastern suburbs – leading to the discovery of a bag of cocaine in the cup holder – has faced court to answer for his “atrocious” conduct.
Paul Diks, 53 of St Ives, was represented by his lawyer Ahmad Faraj at Waverley Local Court on Wednesday, where he pleaded guilty to driving with a low-range drink driving and cocaine possession
According to police facts tendered to court about 11.30pm on July 14 police stopped Diks when they noticed him driving in a “No Entry” area at the Bondi Junction bus interchange reserved for public transport and emergency vehicles.
When questioned Diks told police he had been trying to pick up his girlfriend from the Meriton apartments nearby and admitted he had consumed about five beers earlier that day.
Diks returned a positive reading from a breath test, with a low range blood alcohol reading of 0.06.
Police found a small resealable plastic bag in the drink holder of the car they believed to be cocaine – and a second bag in the inside door compartment weighing 2g in total.
Diks told police, “that is my bag of cocaine I would have consumed about a week ago” and also said he had bought cocaine from a pub and snorted some earlier that day.
Police arrested Diks and took him to Waverley police station where they observed he had a mild smell of intoxicating liquor and was believed to have been slightly affected by alcohol
Mr Faraj asked the court to consider a lengthy conditional release order without conviction for his client.
Magistrate Ross Hudson said while the court could consider leniency for the drug matter, he said Diks’ driving history was serious.
“His driving record is atrocious,” Magistrate Hudson said.
The magistrate allowed the matter to be adjourned for Mr Faraj to apply for merit for his client.
The matter is listed for sentence on August 30.
