A late night staring contest gone wrong outside a Bondi kebab shop ended with a diminutive woman slapping a man who knocked down her towering fiance.
Nicole Hendrie, 27, of Maroubra was sentenced to a two year conditional release order without conviction for the charge of common assault which took place outside Bite Box on Campbell Parade.
Hendrie’s lawyer Andrew Sant told Waverley Local Court on Tuesday his client was “truly mortified” by her “foolish behaviour” outside the popular post drinks pit stop.
The assistant contract administrator at Samsung C and T, the construction and engineering arm of the technology giant, jumped to the defence of her fiance and co-accused Lewis Daley after a verbal argument turned physical.
Court documents state the victim and his three male friends believed Hendrie and Daley were staring at them and so began looking in their direction at which point Hendrie began to swear and shout.
“The co-accused (Daley) grabbed hold of the victim’s neck where a physical altercation occurred,” police facts read.
“During the altercation the co-accused was knocked to the ground. The co-accused landed on his head with great impact.”
Mr Sant said it was only once her fiance was injured that Hendrie physically entered the fray.
“She did so, in a way, to protect her fiance,” Mr Sant said.
The court documents state after Daley’s head hit the ground, the victim stepped toward him prompting Hendrie to grab the victim’s shirt and push and slap him “using open palms”.
Mr Sant told Magistrate Jacqueline Trad that Ms Hendrie was in “disbelief” she and Mr Daley were the ones arrested rather than their combatants.
However she “understands her conduct was not acceptable”.
Magistrate Trad said she hoped the court appearance would be a “wake up call” to Ms Hendrie who spent eight hours locked in the cells after her 1am arrest.
“You say it’s an embarrassment, the situation, and I imagine it would be,” Magistrate Trad said.
Magistrate Trad said she took into account Ms Hendrie’s otherwise clean record and early guilty plea when handing down her sentence.
Daley will appear before the court on September 29.
