A carpenter who unleashed a barrage of punches in a drunken quarrel at an eastern suburbs venue has been told by a magistrate his actions would’ve left his mother “heartbroken”.
Jye Lachlan Tarne, 24, of Albion Park, was supported at Waverley Local Court by his mother, father and sister on Tuesday where he was sentenced after pleading guilty to assault occasioning actual bodily harm while in company.
Agreed facts tendered to the court reveal he was staying at Hotel Bondi where he was drinking with his friend Jarryd Ellul in the early hours of April 1.
The pair were approached by two men who joined them at the table. The two parties did not know each other.
A short time later, the victim stood up and started arguing with Tarne and Ellul before leaving for a brief moment.
He returned and continued arguing before Tarne appeared to punch him in the mouth and narrowly missed him with a second strike, court documents state.
The 24-year-old then threw another punch and hit the victim in the face.
Ellul, who has pleaded not guilty to the assault, allegedly threw a left hook at the victim as Tarne punched the victim another two times to the face.
Court documents state a staff member tried to grab Tarne who pulled away and rejoined the violence. Security stepped in and after the victim was helped to his feet, he allegedly stomped on the head of Ellul three times, according to the agreed facts.
When police arrived they saw the victim’s nose was “significantly displaced” with cuts to his face. He was taken to hospital.
Tarne and Ellul were stopped by police on Campbell Pde and arrested.
On Tuesday, Tarne’s lawyer David Newham told the court his client had consumed about 10 drinks before the attack.
He said he wasn’t victim blaming but said Tarne was called a “f**kwit” by the victim, who also told Tarne “f**k you, I’ll smash you”.
“It doesn’t excuse his conduct, it was an over-reaction for sure,” Mr Newham said.
He described the attack as “a spur of the moment thing” and called on the court not to impose a conviction.
In response, Magistrate Jacqueline Milledge said: “absolutely not … not for this level of violence”.
“It just shows you how quickly things can get away from you … you’ve tarnished your good reputation,” she told Tarne.
She acknowledged his family support and imposed a conviction and $2000 fine.
Ellul’s proceedings will be mentioned in court next month.
