An aspiring investment banker who repeatedly punched a man at a Double Bay pub has been told he is asking for an invite to jail.
Dylan Yelutas, of Kogarah, appeared at Waverley Local Court on Wednesday after pleading guilty to assault occasioning actual bodily harm.
Agreed facts tendered to court reveal the 20-year-old was at the Golden Sheaf Hotel at Double Bay on April 5 when he started talking to the victim, Lachlan Gawdat’s girlfriend.
Mr Gawdat saw Yelutas put his arm over his girlfriend’s shoulder and in response positioned himself between the pair.
Yelutas asked “is that your girlfriend?”, to which Mr Gawdat replied “yes”.
After Mr Gawdat turned to face his girlfriend Yelutas came at him and was pushed away.
Yelutas advanced at him a second time with the pair pushing their heads together, before Yelutas punched the victim three times.
The pair were separated before Yelutas broke free and came at Mr Gawdat for a third time, and landed another blow which caused his mouth to bleed. Security soon arrived and separated the pair.
Yelutas was arrested by police who observed blood on his shirt and was then taken to Waverley police station.
On Wednesday, Magistrate Ross Hudson acknowledged there was a degree of provocation from the victim and noted Yelutas’ had recently stopped taking his ADHD medication.
The court heard he worked as a financial broker for two weeks before being stood down “due to his criminal record” and his goal was to work in IT or investment banking.
Mr Hudson accepted Yelutas was remorseful, however said his record “is starting to work against him”.
He decided against taking action on two of threebreaches of court orders, which included charges of drug supply, deal with property proceeds of crime, drive motor vehicle while suspended and custody of knife in public.
Yelutas was re-sentenced for a domestic violence related common assault, with an conditional release order replaced with a six-month community correction order.
For the attack at the Golden Sheaf Hotel, he received an 18-month community correction order and must complete 80 hours of community service.
“You are seriously inviting the court to send you to jail,” Mr Hudson said.
“Someone has asked you … to step away from their girlfriend …. that’s it … but on this particular occasion you lost control.
“There is now a pattern starting to emerge … of you having some distorted view that you solve things with violence … that distorted view ends today.
“Here you appeared you had to prove a point, any point will be proved in the future … that you are an excellent candidate to go to jail.”
