Former Waverley councillor Sam Einfeld allegedly assaulted father, broke phone

The cousin of disgraced Judge Marcus Einfeld is facing criminal charges after allegedly assaulting his own father and breaking a telephone and kitchen utensils during a family altercation in Bondi Junction.

In 1999 he was elected as one of the country’s youngest local government representatives, now the former boy wonder is facing two criminal charges after a family feud allegedly boiled over in the eastern suburbs.

Ex-Waverley councillor Sam Einfeld, the cousin of disgraced Federal Court Judge Marcus Einfeld who was jailed for three years over lying about a speeding ticket, has found himself foul of the law.

The 40-year-old is accused of assaulting his father David and causing him actual bodily harm between 6pm and 7pm on July 21.

Police also allege he broke a telephone and kitchen utensils belonging to his parents at their Bondi Junction home during the altercation.

His lawyer Greg Walsh yesterday told the Waverley Local Court his parents did not wish to proceed with the charges and AVO, but after unsuccessful representations were made to the police, the matter would have to go down for a hearing next year.

The police will call on three witnesses, one officer and two civilians, to give evidence about what happened on the night.

Einfeld has been on bail since the incident, and was accompanied by his parents in the courtroom yesterday.

According to his LinkeIn page, since leaving council in 2004 Einfeld went on to practice law with Minter Ellison before taking on a variety of consultancy roles.

The same page lists his time on council and campaign as an independent “not supported by any political party, but was run by myself and close friends, family and supporters”.

His matter has been adjourned for a hearing in March 2020.

Upon launching his campaign for public service, former Federal Court Justice Marcus Einfeld was pictured with a fresh-faced 20-year-old Sam in a story where he spoke openly about following in his family’s footsteps.

He is also the grand-nephew of ALP stalwart Syd Einfeld.

“He (Syd) was a terrific fellow and inspired me to get involved in politics and public duty,” he said at the time.
